4) The Supply of Goods and your Right to cancel

All Johny Todd Ltd. products are supplied as per the descriptions, specifications and according to the images published on The Site only.  Any products purchased on The Site will be subject to specific and stringent option selections, per product, per sale, which are finalised by customers within their ‘Cart’ and paid for at ‘Checkout’.

All customers are advised that selections made in this purchase process are taken as the specific parameters for orders and products, and it may not be possible to change these parameters once an order is placed, or a product has been made.

As a general rule, production of orders will be commenced on our next ‘working day’ after said goods have been ordered - this includes after hoilday periods too. Dispatch of goods will usually be within 2-5 days of an order being placed, and sooner if express delivery has been selected, except for holiday periods and during busy calendar periods such as Christmas.

During busy periods our standard dispatch time scale may need to be extended to 5-7 days from an order being placed.

All customers have the right to cancel unpersonalised and uncustomised orders for products under the The Distance Selling Regulations which gives consumers extra protection when buying online.

You have the right to cancel the purchase of unpersonalised and uncustomised goods without having to give a reason within 14 working days.[*]

If you are in possession of the goods you are under the duty to retain them and take reasonable care of them. You must send the goods back to us to our contact address at your own cost (unless we delivered the item to you in error or the item is damaged or defective) as soon as possible after you have notified Johny Todd Ltd. of your intent to return.

Distance selling regulations do not apply to services such as dated or future workshop sessions or vouchers for workshop.

We reserve the right to make a charge not exceeding our direct costs of recovering the goods if you do not return the goods or return them at our expense.

Once you have notified us that you wish to return any goods, any sum debited to us will be refunded to you as soon as possible and in any event within 30 days of your cancellation providing the goods have been returned.

[*]You DO NOT have any right to cancel a purchase of goods made to your specifications, that are highly customised or that are personalised.

NB: most items on The Site will fall into this category, but Johny Todd Ltd. try to work with customers to find a reasonable solution of return or exchange for wholly unpersonalised items.

Products that are personalised or made to your specifications are classified as ‘Non-returnable goods’.

All photographic images or illustrations provided on the site are for illustrative purposes only and no guarantee is given that the colour or tones shown in the site’s images will 100% match the items supplied for any order. As with all organic materials, variations in tone, colour or texture from batch to batch are normal. All photographic representations of Johny Todd Ltd. products are specifically taken under professional photographic conditions and as such, items can appear differently under domestic lighting conditions, daylight or any other situation. We strive for consistency, but the colours and tones can alter, or be unavailable, from those shown in the images over time. The colour sample image accompanying all product listings is the definitive authority for colour/tone for each product and the final decision of what is acceptable remains with Johny Todd Ltd in perpetuity.

All returns should be sent to: Johny Todd Ltd. at Woodings Yard Studios, 3 Woodings Yard, Stafford. ST17 4BG. UK as stated in our Shipping and Returns Policy.

5) Notices

All notices you send us must be sent to the contact details on this site. We may give notice to you at either the email or postal address you provide to us when making a purchase. (Notice will be deemed received and properly served 24 hours after an email is sent or three days after the date of posting of any letter.) In providing the service of any notice, it will be sufficient to prove, in the case of a letter, that the letter was properly addressed, stamped and placed in the post and, in the case of an email that the email was sent to the specified email address of the addressees.

6) Workshop sessions and attendance

All and any workshop session dates are given in good faith that the conditions and circumstances for any workshop session to occur exist. Non-attendance of a specially dated/timed workshop session, without notice given of absence, will result in forfeit of all fees paid.

Future dated workshop vouchers/sessions: these remain active for 24 months, but expired vouchers can be reactivated with a rebooking fee of £35.00 up to 36 months after the initial purchase date. For reactivation after this time span please contact us for the best way forward.

Specific workshop dates: once this has been booked or confirmed an attendee should assume this date is definitely booked. For the purposes of Johny Todd Ltd. any specific workshop date will be a ‘set’ date within the workshop calendar. Alterations to attend a specific workshop date can be made up to 2 weeks prior to comencement if we have availability. We usually request that notice no less than 1 week be given for any emergency absence from a workshop session, but contact should be made if this time is shorter.

We try to opperate a sensible approach towards unforeseen disruption caused by industrial action, but Johny Todd Ltd reserve the right to charge a rebooking fee if applicable. Without sufficient notice of abscence being given by the attendee (which means we will not be able to find a repacement attendeee) all fees are forfeit and a rebooking fee of at least £35 will be payable.

For postponement of workshops that were originally purchased for a specific calendar date, a flat rate rebooking fee of £20 is applicable for each postponement.

Failure to attend a booked and/or dated session without prior notice will be taken by Johny Todd Ltd as a completed workshop and all fees forfeit without recourse to re-book.

The minimum age of attendee is 16 years old, but each attendee under the age of 18 must be accompanied by a full paying adult who assumes parental responsibility - proof of age/ID may be requested.

Johny Todd Ltd. will endeavour to provide all possible help to make the completion of a particular workshop possible, but the final finished item’s quality will depend on the attendee’s competance, attention to instruction and the speed at which they work on the day. Johny Todd Ltd. reserves the right to end a workshop session at a specifically stated time even if participants have not completed the given task(s). Small sundries such as needles and thread will be offered for purchase in the event that a participant does not complete, or is far from completing, a specific workshop, session or course. All possible help will be provided, but the final result will be an item made by the workshop participant so there is a possibility that the item will need to be completed by the participant after the session has ended and away from the Johny Todd Ltd. studios.

Johny Todd Ltd. will strive to ensure that all planned workshop dates proceed as planned, but reserves the right to cancel or postpone any workshop date at short notice due to serious illness, bereavement or any other extreme circumstance which makes a planned workshop session untenable, unsafe or unworkable.

Johny Todd Ltd. also reserves the right to postpone or reschedule a specifically dated workshop session if there are insufficient attendees for a specific date (this being below x3 attendees), it is unlikely that further attendees will book onto a specific dated session, or that a previously specifically dated session becomes unavailable for any reason whatsoever. However, Johny Todd Ltd will always strive to ensure that specific dated workshop sessions proceed and that these are postponed only if no alternative can be arranged.

As such we recommend that attendees consider travel/holiday insurance, or other security, to cover any associated travel/accommodation losses that may be incurred in the event of a “short notice” cancellation of any workshop session. Johny Todd Ltd will not be liable for any losses that workshop participants may occur in the event of a session cancellation caused by serious illness, and/or bereavement of Johny Todd Ltd. staff, or for any other extreme circumstance, industrial action or other event outside of their control, or an occurrence which makes a planned workshop session untenable, unsafe or unworkable.

7) Guarantees

All Johny Todd Ltd. products are guaranteed for 1 year from the date of purchase against any fault in construction or defect that can be reasonably deemed to interfere with the proper functioning of the product.  Exceptions to this are for watch batteries.  Johny Todd Ltd. does not provide guarantees for watch batteries, but will work reasonably with customers to provide a ‘better than expected’ practice.

All guarantees given are at the sole discretion of Johny Todd Ltd.   Your statutory rights are not affected.
